An historic breakthrough in India!
After nearly 150 years, a Delhi High Court ruled today that applying Section 377 of the Indian Penal Code to consenting adults violated the Constitution and international human rights conventions. Section 377 had been introduced under a British colonial law by Lord Macaulay in 1860 and classified homosexual intercourse alongside paedophilia and bestiality as "sex against nature."
This is a huge step. While the ruling is non-binding outside Delhi, and can be appealed at the Supreme Court, it is being hailed nonetheless as a landmark in an aggressive campaign to have Section 377 repealed nationwide. Yes! Enough already with the legacy of British colonial homophobia.
